PUBLIC OFFER AGREEMENTFOR THE PROVISION OF TOURISM SERVICESAlmaty Nomads Group LLP | Website: almatynomads.com | Version dated 2 July 2026Important: this Public Offer Agreement is intended for publication on the Company’s website and for sending to Customers when booking tours through WhatsApp and other communication channels. Payment of a deposit, full payment, written booking confirmation or any other action indicating acceptance of these terms shall constitute full and unconditional acceptance of this Agreement by the Customer.1. General Provisions1.1. This document is a public offer of Almaty Nomads Group LLP (the “Company”) and sets out the terms and conditions for the provision of tourism, excursion, transportation, organisational and related services (the “Services”).
1.2. This Offer is addressed to an indefinite number of persons and constitutes the Company’s official proposal to enter into an agreement for the provision of tourism services on the terms set out below.
1.3. This Offer has been prepared with regard to the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan “On Tourism Activities in the Republic of Kazakhstan”, consumer protection legislation, personal data legislation and other applicable laws and regulations of the Republic of Kazakhstan.
1.4. This Offer applies to all bookings made through the Company’s website, WhatsApp, Telegram, Instagram, e-mail, telephone and any other communication channels used by the Company.
1.5. If specific terms of a tour, route, price, departure time, duration, scope of services or other material terms have been agreed with the Customer in correspondence, an invoice, booking confirmation, voucher, tour catalogue or other message from the Company, such terms shall form part of the agreement between the Company and the Customer.
1.6. In the event of any inconsistency between individually agreed tour terms and the general provisions of this Offer, the individually agreed terms shall prevail, provided that they have been expressly confirmed by the Company.
1.7. The Company may amend this Offer. A new version shall become effective upon publication on the Company’s website, unless otherwise stated in the new version. Bookings confirmed before such publication shall be governed by the version effective at the time of acceptance, unless otherwise agreed by the parties.
2. Terms and DefinitionsFor the purposes of this Agreement, the following terms shall have the meanings set out below:
Company — Almaty Nomads Group LLP, the provider of tourism and related services.
Customer / Tourist — an individual or legal entity that contacts the Company, books a tour, pays a deposit or full price, or actually uses the Company’s Services.
Offer — this public agreement for the provision of tourism services.
Acceptance — full and unconditional acceptance of this Offer by the Customer, including by payment of a deposit, full payment, written booking confirmation or any other action indicating agreement with the terms of this Offer.
Tour — a tourism, excursion, transportation or other programme organised by the Company independently or with the involvement of partners.
Booking — agreement on the tour, date, number of participants, price, programme and other terms, as confirmed by the Company in correspondence or another communication channel.
Deposit — an amount paid by the Customer to reserve a date, guide, transport, place in a programme or other resources required for the organisation of the tour.
Partners — guides, drivers, transportation companies, hotels, yurt camps, national parks, museums, instructors, activity operators and other persons engaged by the Company for the performance of a tour.
Force Majeure — circumstances of irresistible force and other circumstances beyond the control of the Company and the Customer that prevent performance of obligations or create a safety risk.
3. Subject Matter of the Agreement3.1. The Company undertakes, upon the Customer’s request, to organise and/or provide tourism, excursion, transportation, consulting, informational and related services, and the Customer undertakes to accept and pay for such services in accordance with this Offer and the individually agreed booking terms.
3.2. The Company’s Services may include:
- organisation of private and group tours in the Republic of Kazakhstan;
- organisation of one-day and multi-day routes;
- excursion guiding;
- services of a guide, driver, instructor or accompanying person;
- transportation services, including passenger cars, minivans, off-road vehicles and other types of transport;
- organisation of visits to natural, cultural, historical and tourist sites;
- organisation of accommodation, meals, transfers and activities, if such services are included in the tour programme;
- informational support and consultations regarding route, timing, weather, equipment and other matters.
3.3. The specific scope of services for each tour is determined by the tour programme, individual correspondence, booking confirmation, invoice, voucher or other message from the Company.
3.4. The Company may engage third parties and partners to perform individual parts of the tour, remaining the responsible organiser within the limits provided by this Offer and the laws of the Republic of Kazakhstan.
4. Booking Procedure via WhatsApp and Other Channels4.1. The Company’s primary booking channel is WhatsApp. Bookings may also be made through the website, Instagram, Telegram, e-mail, telephone and other channels used by the Company.
4.2. To book a tour, the Customer provides the Company with the necessary information, including but not limited to:
- name and contact telephone number;
- date or preferred period of the tour;
- number of participants;
- selected tour or desired route;
- guiding language;
- meeting point or hotel address;
- special wishes, health limitations, age of participants, presence of children, need for child seats, dietary requirements or other important information;
- any other information necessary for the organisation of the tour.
4.3. The Company provides the Customer with information about tour availability, preliminary or final price, scope of services, start time, duration, payment terms, deposit amount and other material terms.
4.4. Before payment of the deposit and booking confirmation, information about the availability of a date, transport, guide, accommodation, tickets and price may change.
4.5. A booking is considered confirmed only after acceptance of the Offer by the Customer and booking confirmation by the Company.
5. Acceptance of the Offer by Payment of the Deposit5.1. Acceptance of this Offer shall be any of the following actions by the Customer:
- payment of a deposit for the tour;
- payment of the full tour price;
- written confirmation of agreement with the tour terms and this Offer in WhatsApp, Telegram, Instagram, e-mail or another communication channel;
- actual participation in the tour after receiving information about the terms of this Offer.
5.2. From the moment of acceptance of the Offer, the agreement between the Company and the Customer shall be deemed concluded in electronic form and shall not require signing a separate paper document, unless otherwise agreed by the parties.
5.3. The Customer confirms that before accepting the Offer he or she had the opportunity to read its terms, understood their content, accepts them fully and unconditionally, and confirms the accuracy of the information provided.
5.4. If the booking is made by one person in the interests of a group of tourists, such person confirms that he or she is authorised to act on behalf of all group participants, has informed them of the terms of this Offer and is responsible for providing them with all material information.
6. Booking Confirmation6.1. After receipt of the deposit or other form of acceptance, the Company sends the Customer a booking confirmation via WhatsApp or another agreed communication channel.
6.2. The booking confirmation may include: the tour date, tour name, route, departure time, meeting point, number of participants, price, deposit amount, remaining balance, included and excluded services, contact details of the accompanying person and other important information.
6.3. The Customer must check the details in the booking confirmation and promptly inform the Company of any errors or inaccuracies. If the Customer does not report any errors before the tour starts, the terms shall be deemed agreed.
6.4. Correspondence in WhatsApp and other messengers may be used by the parties as evidence of agreement on the booking terms, route changes, price, timing or other tour terms.
7. Service Price7.1. The tour price is determined by the Company individually depending on the selected programme, date, number of participants, guiding language, transport, duration, season, partner service costs and other factors.
7.2. The tour price includes only those services that are expressly stated by the Company in the tour programme, invoice, message or booking confirmation.
7.3. Unless expressly stated otherwise by the Company, the tour price may exclude meals, personal expenses, tips, medical insurance, flights, visas, additional tickets, optional activities, expenses arising from route changes requested by the Customer and any other services not stated as included.
7.4. The price may be quoted in tenge, US dollars, euros or another currency. Payment shall be made in the currency and by the method agreed by the parties at the time of booking, subject to the laws of the Republic of Kazakhstan.
8. Payment Procedure8.1. To confirm a booking, the Customer pays a deposit in the amount specified by the Company. The deposit amount may depend on the type of tour, date, number of participants, need to reserve transport, guide, accommodation, tickets and other services.
8.2. The remaining balance of the tour price shall be paid in the manner and within the time limits agreed by the parties at the time of booking.
8.3. The Company is not obliged to reserve a date, transport, guide, accommodation, tickets or other resources until the Customer has paid the deposit, unless expressly agreed otherwise by the Company.
8.4. All bank charges, payment service fees, transfer costs, currency conversion costs and other payment-related expenses shall be borne by the Customer, unless otherwise agreed by the parties.
8.5. The Customer’s payment obligation shall be deemed fulfilled when the funds are actually received by the Company or when payment is confirmed by a method accepted by the Company.
9. Change of Price Before Booking Confirmation9.1. Before payment of the deposit and booking confirmation, the tour price is preliminary and may be changed by the Company due to changes in service availability, partner tariffs, transportation costs, accommodation costs, tickets, entrance fees, seasonal coefficients and other factors.
9.2. After booking confirmation, the Company shall not change the tour price without the Customer’s consent, except where the change is caused by circumstances beyond the Company’s control, including changes in state fees, entrance tickets, national park tariffs, costs of mandatory third-party services, significant changes in transportation costs or force majeure circumstances.
9.3. If, after booking confirmation, the Customer requests changes to the programme, route, date, number of participants, transport, accommodation or other terms, the Company may recalculate the price.
10. Changes to the Tour Programme10.1. The Company seeks to follow the agreed tour programme; however, the order of visiting locations, departure time, duration of stops and individual route elements may be changed for objective reasons, including weather conditions, road situation, traffic, road closures, queues, national park restrictions, decisions of state authorities, tourist safety and other circumstances.
10.2. A change in the order of visiting locations shall not be considered improper performance of services if the general nature of the tour is preserved and the Company has taken reasonable measures to organise the tour.
10.3. If visiting a particular location becomes impossible for reasons beyond the Company’s control, the Company may offer an alternative location, route change, rescheduling of the visit or another equivalent option taking into account the actual circumstances.
11. Cancellation by the Customer11.1. The Customer may cancel the booking by notifying the Company through WhatsApp or another agreed communication channel.
11.2. Refund conditions for the deposit and other amounts depend on the cancellation date, type of tour, expenses already incurred by the Company, partner terms and the need to reserve transport, accommodation, tickets, guides, instructors and other services.
11.3. If the Company has already incurred non-refundable expenses for the organisation of the tour, such expenses shall be deducted from any amount subject to refund, regardless of the reason for cancellation by the Customer.
11.4. Non-refundable expenses may include transportation booking, guide work, accommodation reservation, tickets, entrance fees, partner services, administrative expenses, transfer fees and other expenses actually incurred by the Company.
11.5. Cancellation on the day of the tour, late cancellation, significant reduction of the number of participants without prior agreement, or refusal to participate after the tour has started may result in the retention of the deposit or the full tour price in the amount of actual expenses incurred and the lost opportunity to provide the service to another customer.
12. Cancellation by the Company12.1. The Company may cancel a tour in whole or in part where the tour is impossible, unsafe, unlawful, substantially difficult or unreasonable to conduct for objective reasons.
12.2. Grounds for cancellation by the Company may include, among others:
- adverse weather conditions;
- closure of roads, mountain passes, national parks, tourist sites or individual locations;
- orders of state authorities, police, rescue services, national park administration or other authorised persons;
- risks to life, health or safety of tourists;
- accidents, vehicle breakdowns or road incidents;
- force majeure circumstances;
- illness or inability of a guide, driver or instructor to perform the tour where no reasonable replacement is available;
- other circumstances beyond the Company’s control.
12.3. In the event of cancellation for reasons depending solely on the Company and not related to force majeure, weather, safety, actions of third parties or circumstances beyond the Company’s control, the Company shall offer the Customer a refund of funds received or rescheduling to another date.
12.4. In the event of cancellation for reasons beyond the Company’s control, the provisions on force majeure, weather conditions, rescheduling and refund of funds shall apply.
13. Rescheduling of the Tour13.1. By agreement of the parties, the tour may be rescheduled to another date if possible, taking into account the availability of the guide, transport, accommodation, tickets, weather conditions and other factors.
13.2. If rescheduling is requested by the Customer, the Company may recalculate the price and retain actually incurred expenses.
13.3. If rescheduling is caused by circumstances beyond the control of the parties, including weather conditions, road closures, national park closures or other circumstances creating a safety risk, the Company shall offer the Customer reasonable alternatives: rescheduling to another date, route change or an equivalent exchange for another available tour.
14. Refund of Funds and Deposits14.1. The deposit is a means of reserving a date, guide, transport, place in a programme and other resources required for the organisation of the tour.
14.2. The deposit shall be refunded only in the cases and manner provided by this Offer, individually agreed booking terms and the laws of the Republic of Kazakhstan.
14.3. The deposit is non-refundable if the Customer cancels the tour after the Company has incurred non-refundable expenses or reserved resources that cannot be cancelled without loss.
14.4. If the tour cannot be conducted due to force majeure, adverse weather conditions, road closures, national park closures or other circumstances beyond the control of both the Company and the Customer, the deposit is non-refundable. Instead of a refund, the Company shall offer the Customer an equivalent exchange for another available tour on the same date or carry the deposit forward as credit for another tour or another date, if such option is available.
14.5. If the alternative tour costs more than the original tour, the Customer shall pay the difference. If the alternative tour costs less, the difference may be credited towards additional services or a future booking by agreement of the parties.
14.6. If the Customer refuses reasonable alternatives offered by the Company in the event of force majeure, adverse weather or route closure for safety reasons, the deposit is non-refundable because the Company has already reserved resources and incurred organisational expenses.
14.7. Where a refund is due, it shall be made in the manner and within the time limits agreed by the parties, less actual expenses incurred, commissions, bank charges and other deductions provided by this Offer.
15. Force Majeure15.1. The parties shall be released from liability for full or partial non-performance of obligations if such non-performance is caused by circumstances of irresistible force or other circumstances beyond the control of the parties.
15.2. Such circumstances include, but are not limited to, natural disasters, earthquakes, mudflows, avalanches, rockfalls, fires, floods, strong winds, snowfall, fog, ice, road closures, epidemics, quarantine measures, military actions, civil unrest, terrorist threats, decisions of state authorities, national park restrictions, accidents, transport disruptions, infrastructure failures and other circumstances beyond the reasonable control of the parties.
15.3. In the event of force majeure, the Company may change the tour programme, replace individual locations, reschedule the tour, offer an alternative tour, shorten the route or cancel the tour if necessary for tourist safety.
15.4. In the event of force majeure, the deposit is non-refundable if the Company has incurred organisational expenses or reserved resources for the tour. Instead of a refund, the alternative options provided by this Offer shall apply.
16. Weather Conditions and Closure of Locations16.1. The Customer understands and accepts that the Company’s tours are often conducted in natural environments: mountains, canyons, lakes, rivers, plateaus, national parks, dirt roads and other places where weather and natural conditions may change quickly.
16.2. The Company does not guarantee sunny weather, absence of rain, snow, fog, strong wind, ice, heat, cold, high water levels, mud, dust, rockfalls, avalanche danger, road closures, route closures or the possibility of visiting all announced locations.
16.3. The Company may change the route, departure time, duration of stops, order of visiting sites or replace individual locations if weather conditions, road conditions, requirements of state authorities or other circumstances create a risk to tourist safety.
16.4. Inability to visit a particular location due to weather, road closure, order of state authorities, national park administration or other objective circumstances shall not constitute breach of the Company’s obligations if the Company offered a reasonable alternative or took measures to conduct the tour safely.
17. High-Risk Activities and Nature Routes17.1. The Customer confirms that he or she understands the nature of tourism services related to natural and active routes and is aware of increased risks that cannot be completely eliminated even when safety measures are followed.
17.2. Activities and conditions involving increased risk may include, but are not limited to:
- mountain routes, plateaus, gorges and passes;
- canyons, rocky areas, cliffs and stony trails;
- lakes, rivers, shores and water activities;
- horseback riding and interaction with animals;
- walking routes, hiking, ascents and descents;
- off-road trips, dirt roads, serpentine roads and rough terrain;
- cable cars, winter routes, snow, ice and slippery surfaces;
- SUP, kayaks, ATVs, motorcycles, bicycles and other active recreation if included or additionally requested by the Customer.
17.3. By participating in such tours and activities, the Customer confirms that he or she voluntarily accepts the possible risks, undertakes to comply with the instructions of the Company, guide, driver, instructor, site administration and authorised persons, and is responsible for his or her own actions, physical fitness and health condition.
17.4. The Company may refuse the Customer’s participation in individual activities or restrict the Customer’s participation if it considers that the Customer’s condition, behaviour, footwear, clothing, equipment, level of preparation or other circumstances may create a risk to the Customer, other participants, Company staff or third parties.
18. Medical Insurance and Customer’s Health18.1. The Customer is solely responsible for having valid medical insurance for the entire period of travel and participation in the Company’s tours.
18.2. If the Customer chooses active, mountain, water, horse-riding, off-road, winter or other types of tours, the Customer must independently ensure that his or her insurance covers the relevant type of activity and possible risks.
18.3. The Company does not provide insurance for the Customer unless such service is expressly stated as included in a specific tour. The Company is not liable for the Customer’s lack of insurance, insufficient insurance coverage, refusal of an insurer to pay, medical treatment costs, evacuation, transportation, hospitalisation, medication, diagnostics or any other medical expenses.
18.4. The Customer independently assesses his or her health condition, physical fitness and ability to participate in the selected tour. The Customer must inform the Company in advance of illnesses, injuries, allergies, dietary restrictions, pregnancy, disability, health conditions or other circumstances that may affect the safety of participation in the tour.
18.5. Failure by the Customer to provide information about health conditions, contraindications or restrictions releases the Company from liability for consequences related to such circumstances.
19. Customer Illness19.1. In the event of illness, injury or deterioration of the Customer’s health before the start of the tour, the Customer must immediately notify the Company.
19.2. Cancellation of the tour due to the Customer’s illness shall be treated as cancellation by the Customer, unless otherwise agreed by the parties. The deposit and other amounts may be retained in the amount of the Company’s actual expenses incurred.
19.3. If the Customer’s condition deteriorates during the tour, the Company may change the programme, suspend the Customer’s participation in certain activities, call medical assistance or take other reasonable measures. All expenses related to medical assistance, evacuation, transport, additional accommodation or route changes due to the Customer’s condition shall be borne by the Customer.
20. Late Arrival and No-Show20.1. The Customer must arrive at the agreed meeting point at the agreed time.
20.2. If the Customer is late, the Company may shorten the tour programme, change the route, stop times or duration of individual parts of the tour without reducing the price.
20.3. If the Customer is so late that the tour becomes impossible or substantially disrupts the programme, safety, partner reservations or the interests of other participants, the Company may treat the tour as cancelled by the Customer.
20.4. Failure by the Customer to appear at the agreed time and place without timely notice to the Company shall be grounds for retaining the deposit or the full tour price.
20.5. The Company is not liable for the Customer’s late arrival caused by traffic, flight delay, baggage issues, immigration control, incorrect address, lack of communication or other circumstances on the Customer’s side.
21. Customer Conduct Rules21.1. The Customer must comply with the laws of the Republic of Kazakhstan, rules for visiting national parks, protected areas, museums, religious sites, hotels, transport and other places of visit.
21.2. The Customer must treat other participants, Company staff, guides, drivers, partners, local residents, cultural and religious traditions with respect.
21.3. The Customer is prohibited from:
- violating instructions of the guide, driver, instructor or site administration;
- deviating from the route without permission;
- approaching dangerous areas, cliffs, water, animals or vehicles without permission;
- using alcohol or drugs before activities or during the tour if this creates a safety risk;
- damaging property, nature, historical sites, transport or property of third parties;
- creating danger to oneself, other tourists, Company staff or third parties;
- committing actions that violate the laws of the Republic of Kazakhstan.
21.4. In the event of a gross violation of conduct rules or safety requirements, the Company may refuse the Customer’s further participation in the tour without refunding the service price.
22. Safety Requirements22.1. The Customer must comply with all instructions of the Company, guide, driver, instructor, site administration and authorised persons.
22.2. The Customer must use seat belts in vehicles, protective equipment, life jackets, helmets and other safety equipment where provided by the programme or partner requirements.
22.3. The Customer is solely responsible for choosing appropriate clothing, footwear and personal equipment suitable for the season, weather, route and activity.
22.4. The Company may recommend necessary equipment but is not liable for consequences caused by unsuitable footwear, clothing, absence of warm clothing, sun protection, water, medication or other personal items of the Customer.
23. Use of Transport23.1. Transport used in tours may belong to the Company, the Company’s partners, transportation companies or third parties engaged for the tour.
23.2. The Customer must follow rules of conduct in transport, use seat belts, not distract the driver, not open doors while the vehicle is moving, not leave litter and not damage the interior or property.
23.3. On nature routes, dirt roads, serpentine roads, mountain passes and off-road sections, shaking, dust, mud, delays, changes in speed, route changes or stops for safety reasons may occur.
23.4. The Company is not liable for delays caused by traffic, road works, accidents, road closures, weather, actions of police, road services, border, migration, environmental or other state authorities.
23.5. The Customer is liable for damage caused by his or her fault to a vehicle, equipment or property of the Company, partners or third parties.
24. Rights and Obligations of the Customer24.1. The Customer has the right to:
- receive accurate information about the tour, programme, price and booking terms;
- receive services in accordance with the confirmed booking;
- contact the Company with questions, requests and complaints;
- refuse to participate in photo and video shooting or refuse use of materials in which the Customer may be identified;
- receive a reasonable alternative in the event of route changes for safety reasons, if such alternative is available.
24.2. The Customer is obliged to:
- provide accurate data necessary for the organisation of the tour;
- pay the deposit and remaining tour price on time;
- independently obtain and maintain valid medical insurance appropriate for the selected types of activities;
- assess his or her health, physical fitness and ability to participate in the tour;
- comply with safety rules, instructions and the laws of the Republic of Kazakhstan;
- treat property, nature, cultural sites, transport and equipment with care;
- be responsible for personal belongings, documents, money, phones, cameras, baggage and other property;
- inform the Company promptly of any circumstances that may affect the conduct of the tour.
25. Rights and Obligations of the Company25.1. The Company has the right to:
- request from the Customer information necessary for the organisation of the tour;
- require payment of a deposit to confirm the booking;
- change the programme, route, time or order of visiting locations for objective reasons and safety considerations;
- cancel or reschedule the tour in the cases provided by this Offer;
- refuse the Customer’s participation in the tour or individual activities in case of violation of safety rules, unsuitable health condition, alcohol or drug intoxication, aggressive behaviour or other risks;
- engage partners and third parties for performance of the tour;
- retain the deposit and actual expenses incurred in the cases provided by this Offer.
25.2. The Company is obliged to:
- provide the Customer with information on the material terms of the tour;
- take reasonable measures to organise the tour in accordance with the confirmed booking;
- act in good faith and with regard to tourist safety;
- inform the Customer of material changes to the route, time, price or other terms if such changes arise before the tour and are known to the Company;
- process the Customer’s personal data in accordance with the Privacy Policy and the laws of the Republic of Kazakhstan.
26. Customer’s Liability26.1. The Customer is responsible for the accuracy of information provided, availability of documents, visas, permits, medical insurance, health condition, physical fitness, personal belongings and compliance with safety rules.
26.2. The Customer is liable for damage caused to the Company, other tourists, partners, third parties, nature, cultural sites, transport, equipment or property as a result of the Customer’s actions or omissions.
26.3. The Customer shall compensate the Company and/or third parties for losses, fines, expenses, property damage and other losses arising through the Customer’s fault.
26.4. If the Customer violates the laws of the Republic of Kazakhstan, rules for visiting sites, safety requirements or instructions, the Customer shall independently bear all legal, administrative, financial and other consequences.
27. Company’s Liability and Limitation of Liability27.1. The Company is liable for proper provision of services within the limits provided by this Offer, the individually agreed booking terms and the laws of the Republic of Kazakhstan.
27.2. The Company is not liable for:
- weather conditions, natural phenomena, closure of roads, national parks, routes or locations;
- decisions of state authorities, police, migration, border, environmental, rescue and other services;
- actions or omissions of the Customer, including violation of instructions, safety rules or laws;
- absence, invalidity or insufficiency of the Customer’s medical insurance;
- costs of medical treatment, evacuation, hospitalisation, medication, diagnostics and other medical expenses of the Customer;
- loss, damage or theft of the Customer’s personal belongings, unless caused by the proven fault of the Company;
- flight, train or taxi delays, baggage issues, document issues, visa issues or migration control issues;
- actions of partners and third parties beyond the Company’s reasonable control, provided that the Company selected such partners in good faith;
- inability to visit individual locations due to circumstances beyond the Company’s control;
- moral damage, lost profit or indirect losses, unless otherwise provided by the laws of the Republic of Kazakhstan.
27.3. In any event, the Company’s liability shall be limited to the cost of the services actually paid by the Customer for the specific tour, except where otherwise expressly provided by mandatory provisions of the laws of the Republic of Kazakhstan.
28. Photography and Videography28.1. During excursions, tours and other events, the Company may take photos and videos for the purposes of documenting the trip, improving service quality, ensuring safety and preparing informational, advertising and marketing materials.
28.2. Use of photographs and video recordings in which the Customer may be identified shall be carried out only with the Customer’s appropriate consent or on other lawful grounds provided by the laws of the Republic of Kazakhstan.
28.3. If the Customer does not wish to participate in photo or video shooting or does not consent to further use of the relevant materials, the Customer may notify the Company before the services begin or at any time during the tour. The Company will take reasonable measures to respect the Customer’s wishes.
28.4. The Customer may not use the Company’s photo, video, text, advertising or other materials for commercial purposes without the Company’s prior written consent.
29. Personal Data29.1. By accepting this Offer, the Customer confirms consent to the collection, processing, storage and use of personal data to the extent necessary to process the request, make the booking, organise and provide tourism services.
29.2. Personal data is processed in accordance with the Company’s Privacy Policy published on the Company’s website and the laws of the Republic of Kazakhstan.
29.3. The Customer agrees that the Company may transfer necessary personal data to partners only to the extent required to perform the tour, book accommodation, transport, tickets, activities, passes and other services.
29.4. The Company may communicate with the Customer by e-mail, telephone, SMS, WhatsApp, Telegram and other means of communication indicated by the Customer when making an inquiry or booking a tour, solely for the purposes of processing the request, organising the tour, providing information about services and other purposes provided by the Privacy Policy.
30. Visa, Migration and Documentation Matters30.1. The Customer is solely responsible for having a valid passport, visa, migration documents, permits, insurance and other documents required for entry, stay and travel within the Republic of Kazakhstan, unless expressly stated otherwise in a specific tour.
30.2. The Company may provide general informational support regarding travel matters; however, the Company is not liable for decisions of consulates, airlines, migration, border, customs or other state authorities.
30.3. Refusal of entry, border delay, problems with documents, visas, migration registration, flight tickets or baggage are circumstances on the Customer’s side and do not release the Customer from payment obligations for the confirmed tour.
31. Intellectual Property31.1. All texts, routes, tour descriptions, photographs, videos, design, logos, trade name, advertising materials, catalogues, tour programmes and other materials of the Company are the Company’s intellectual property or are used by the Company on lawful grounds.
31.2. Copying, distribution, publication, commercial use, modification or other use of the Company’s materials without the Company’s written consent is prohibited.
31.3. The Customer may use his or her own photos and videos taken during the tour for personal non-commercial purposes, provided that this does not violate the rights of the Company, other tourists, partners and third parties.
32. Complaint Review Procedure32.1. All questions, comments and complaints of the Customer shall be sent to the Company in writing through WhatsApp, e-mail or another agreed communication channel.
32.2. A complaint must contain the Customer’s name, tour date, description of circumstances, Customer’s claims and supporting materials, if any.
32.3. The Company shall review the complaint within a reasonable time after receipt and, if necessary, request additional information from the Customer.
32.4. The parties undertake to seek pre-trial dispute resolution through negotiations and exchange of written communications.
33. Governing Law and Dispute Resolution33.1. This Offer, the relationship between the Company and the Customer, and all disputes arising in connection with booking and provision of services shall be governed by the laws of the Republic of Kazakhstan.
33.2. The parties shall seek to resolve all disputes and disagreements through negotiations.
33.3. If pre-trial resolution is not possible, the dispute shall be submitted to the competent court of the Republic of Kazakhstan in accordance with the laws of the Republic of Kazakhstan.
33.4. The invalidity of any individual provision of this Offer shall not affect the validity of the remaining provisions.

36. Final Provisions36.1. By accepting this Offer, the Customer confirms that he or she has carefully read all of its terms, understands their meaning and consequences, and agrees to the booking, payment, cancellation, refund, force majeure, weather risk, medical insurance, high-risk activity and limitation of liability terms of the Company.
36.2. The Customer confirms that participation in the tour is voluntary and that the selected programme corresponds to the Customer’s interests, physical abilities, health condition and level of preparation.
36.3. This Offer shall remain valid indefinitely until withdrawn or replaced by a new version by the Company.
